The Consumer Protection from Unfair Trading Regulations (CPRs) implement the EC Unfair Commercial Practices Directive (UCPD). The Directive harmonises Member States’ laws protecting consumers from unfair trading. It requires traders in all sectors not to behave unfairly towards consumers.
The CPRs apply to the activities of all persons acting in trade or business connected with the supply of goods and services to consumers. The Regulations prohibit those activities which are misleading or aggressive. So the Regulations will not affect the supply of spiritual healing services in themselves. They will however apply to misleading activities related to the supply of such services. Consumers must be protected from misleading activities by traders connected with the supply of all services including spiritual healing services.
The normal benchmark for determining whether a practice is unfair is the average consumer who is reasonably well informed, reasonably observant and circumspect.
Provided any promotional (including advertising and marketing) materials are unlikely to mislead the average consumer into taking a decision he would not otherwise have taken then they are unlikely to be prohibited under the Regulations. The Regulations are not generally prescriptive as to what has to be said in promotional material as long as such material describes the services being offered in a manner which will not mislead the average consumer. Where promotional material is targeted at particular groups of consumers (such as vulnerable ones) or affect vulnerable consumers in a way the trader can foresee the benchmark for determining whether a consumer is misled is looked at from the point of view of the average consumer of that group.
The Regulations do however list 31 specific practices which are banned outright without the need to consider the effect of the practice on the economic behaviour of the average consumer. One of these is “Falsely claiming that a product (good or service) is able to cure illnesses, dysfunction or malformations”. Spiritual healers would need to avoid making such claims where they could not be substantiated.
